Terms of Service

1. Agreement

By accessing or using JIVX (“the Service”), operated at jivx.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Account Terms

  • You must be at least 13 years old to use the Service.
  • You must provide a valid email address to create an account.
  • One person per account. Sharing login credentials is not permitted.
  • You are responsible for maintaining the security of your account and must notify us immediately of any unauthorized access.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.
  • Use automated scripts, bots, or scrapers to access or collect data from the Service.
  • Interfere with or disrupt the Service or servers connected to it.
  • Impersonate any person or entity, or falsely represent your affiliation with a person or entity.
  • Submit intentionally harmful, offensive, or abusive content through any input field.

We may suspend or terminate your access for violations of these terms without prior notice.

4. Subscriptions and Payment

JIVX offers a free tier and paid Pro subscriptions. Pro plans are available on monthly and annual billing cycles and include a 7-day free trial.

  • All payments are processed through Stripe. We do not store your payment card details.
  • Subscriptions automatically renew at the end of each billing period unless cancelled.
  • Prices are subject to change. We will notify you at least 30 days before any price increase takes effect on your next billing cycle.
  • You are responsible for any applicable taxes on your subscription.

5. Refunds

If you are not satisfied with your Pro subscription, you may request a refund within 30 days of your most recent payment. To request a refund, contact us at [email protected].

6. Cancellation and Termination

  • You may cancel your subscription at any time from the Settings page. You will retain access to Pro features through the end of your current billing period.
  • You may delete your account from the Settings page. Account deletion is permanent and removes all your study data, progress, garden, and friend connections.
  • We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion, with or without notice.
  • Accounts that have been inactive for 24 months with no active subscription may have their data removed.

7. AI-Powered Features

JIVX uses third-party AI services to power core features of the product:

  • AI Grading: Your Japanese text answers are sent to Anthropic (Claude) for evaluation. Anthropic processes this data according to their own privacy policy and terms of service.
  • Voice Input: When you use the microphone feature, your audio is sent to OpenAI (Whisper) for transcription. OpenAI processes this data according to their own privacy policy and terms of service.

AI-generated feedback (scores, explanations, corrections) is provided for educational purposes and may not always be accurate. We do not guarantee the correctness of AI output.

8. Intellectual Property

  • All content in the Service — including sentences, audio, artwork, sprites, design, and code — is owned by JIVX and protected by copyright.
  • You may not reproduce, distribute, or create derivative works from any JIVX content without express written permission.
  • Your study data (answers, scores, progress) is your data. You may request an export or deletion at any time.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by law, JIVX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, regardless of the theory of liability.

11. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by posting the updated terms on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in courts of competent jurisdiction.
